Introduction

These DELIVERY TERMS (Terms) apply for the BreastCare WA Pty Ltd STUDIO (STUDIO) and the BreastCare WA Pty Ltd Website (ONLINE).

By placing an Order for a Product, you accept these Terms.

Standard Delivery

You accept that Standard Delivery applies for delivery to an Australian or New Zealand address.

When placing an Order, you agree to provide a Residential or Post Office Box address. For a residential address, you agree that if you do not nominate another easy to access location, the Product will be left by the front door.

You accept that a delivery date, or time of day, cannot be requested.

You accept that Products will not be delivered to a public or private hospital.

Whilst We endeavour to make packaging non-descript, you accept that packaging will vary and ‘BreastCare WA’ will show on the labelling.

You accept that a third-party courier will collect the Product(s) from the STUDIO and deliver it to your nominated address.

Non-Standard Delivery

When an Order is placed with a request for Non-Standard Delivery within Australia or New Zealand, or when an Order is placed for delivery outside of Australia or New Zealand, you accept the terms of Non-Standard Delivery will be confirmed after the Order has been received, and prior to Order confirmation.

Delivery Cost

You agree the Delivery Cost is in addition to the Product price, is in Australian Dollars, and is inclusive of GST, and:

For an Order up to $100, the Standard Delivery Cost will be $10.

For an Order over $100, the Standard Delivery Cost will be $0 (Free Standard Delivery).

If you request another delivery type, you agree the Delivery Cost will be calculated:

For an Order up to $100, as the cost of the requested delivery type.

For an Order over $100, as the cost of the requested delivery type less the cost of Standard Delivery.

If you are physically present at the STUDIO and a Product(s) is not available to take away after purchase, BreastCare WA (We) will deliver the Product(s) to you as a Free Delivery.

Free Standard Delivery

You accept Free Delivery is a special offer and We reserve the right to change the Terms any time.

You accept that Free Delivery will be by Standard Delivery.

Time for Standard Delivery

When placing an Order for a Product you accept the nominal delivery time will be:

7 days from Order confirmation for a Western Australian address.

14 days from Order confirmation for an address in another Australian State.

21 days from Order confirmation for an address in New Zealand.

You accept that stock availability, or transport disruption, or public holidays, or weekends, or an end of year STUDIO closure, may add to the normal delivery times.

Updates

You accept that We may vary these Terms at any time, and that the current version of these Terms is that shown ONLINE at the time of your purchase. By continuing to use the STUDIO, or the ONLINE site, you consent to any variation and agree that it is your responsibility to regularly check these Terms for any variation.

Jurisdiction

You agree that transactions are deemed to have taken place in Burswood, Western Australia.

You agree that these Terms are governed by and construed in accordance with the State of Western Australia, Australia (WA). If a dispute arises from these Terms, you agree to submit to the exclusive jurisdiction of the courts of WA.
